People v. T. Sprague: Client is charged with felony DUI with serious Injuries, (VC 23153(a) and VC 23153 (b) with (3) VC 23540 (2nd DUI) allegation; and (2) Hit & Run, (VC 20002(a). We got case reduced to a misdemeanor, and no in jail custody!!
People v. H. B., Case #: CN416079: Prosecuted for (1) Transporting for Sale a Controlled Substance (Methamphetamine), (Ca Health & Safety Code sec. 11379(a) with Ca Health & Safety Code sec. 11370.4(2) allegation of transporting over 4 kilograms of Methamphetamine in weight which carries a 10 yr + consecutive sentence); and (2) Possessing for Sale a Controlled Substance (Methamphetamine), (Ca Health & Safety Code sec. 11370.4(2) allegation of possessing over 4 kilograms of Methamphetamine in weight which carries a 10 yr + consecutive sentence.) (3) Allegation of Possessing more than 28 grams in weight of Methamphetamine , (Ca Penal Code 1203.073(b)(2) . which carries automatic prison (presumption). Probation Office’s Pre-Sentence Report recommended 7 years in actual prison. Disposition: No ‘in-jail’ Custody! After extensive litigation and mitigation arguments by use of legal memorandum we avoided prison and client was sentenced to Probation with House Arrest for 6 months.
People v. F. A., Case No. CD285908. Client had 10 felonies, 5 charges of Fraud based on False Statements and 5 for Insurance Fraud, (Concealing Facts concerning a insurance claim.), i.e., both species of Misrepresentation & Fraud. These charges coukd have resulted in 30–50 years in prison if run concurrently. FA also had over $16,000.00 in Restitution! Disposition: After extensive litigation and negotiation we pled guilty to only a Misdemeanor conviction for Misrepresentation and only $2000 in Restitution! Client was really happy!
